1 - THE BOOKING
Bookings and subsequent contracts shall be deemed to have been concluded in Arusha, Tanzania, and shall be interpreted according to the laws of the United Republic of Tanzania. The Company reserves the right to decline any booking without outlining the reasons for it. Betheli Expeditions (T) Ltd will create a tailor-made holiday to suit your personal needs. A binding contract comes into existence between us when we receive a deposit of 20% of the quoted price, or when we receive full payment of the holiday when the booking is made less than 45 days before your departure date. No contract will exist between the parties (Betheli Expedition (T) Ltd & customer) until such monies have been received.
2 - PAYMENT TERMS
A deposit of 20% should be paid once the booking is confirmed to guarantee the reservation of the booking. The balance of payment (80%) is due 45 days prior to your date of arrival in Africa or the safari/program start. If your booking is made and confirmed within 45 days of your arrival date, full payment will be required immediately. All net rates are valid on specific dates indicated on specific Trip departures, with the exception of government park fees and flights which are subject to change at any time with/without prior notice. If the park fees or taxes are changed with little or more on no notice we have to increase our rates accordingly. We recommend bookings to be made at the earliest time possible for us to be able to organize everything accordingly.
3 - BOOKING AMENDMENTS
For amendments of existing bookings done by the client/agent (e.g. departure dates, air tickets, accommodation, number of participants, etc) a handling fee of 50 USD per booking applies. The handling fee will be charged in addition to the service provider fees.
4 - CANCELLATIONS NOTE/PENALTY
Cancellations must be sent in writing to Betheli Expedition (T) Ltd. Cancellations shall only be effective from the date of receipt of the cancellation note.
If a booking is canceled the client is subject to a cancellation fee as follows:
45 days before the beginning of the safari 100% cancellation charge is applicable from the total amount due for the safari/trip.
60 days and above but less than 130 days a charge of 50% is applicable from the total amount due for the safaris.
130 days and above we retain 20% of booking handling charges. We may have to reroute the itinerary or accommodate in similar lodges in case of non-availability. Park fees and airline prices may be changed without prior notice. This is beyond our control and any increase levied will be passed on to you.
The prices quoted are based on the dates shown in your expedition proposal.
Changes in dates may lead to a change (increase) in the safari/trek price.
The Company reserves the right to cancel any tour at its sole and absolute discretion, without prior notification in instances where this is unavoidable. However, in that case, the Company agrees to refund all monies already paid by the client. This shall be the Company’s sole responsibility to the client and no claim for any damages, whatsoever arising, shall accrue against the Company.
6 - PASSPORTS, VISAS, AND OTHER TRAVEL PAPERS
It is the client’s sole responsibility to ensure that passports, visas, health certificates, proof of vaccinations, and any other documentation required are all in order for the countries to be visited. The Company cannot be held liable for any consequences, damages, or claims if the client does not attend correctly to the client’s documentation and related matters prior to commencement of the tour.
7 - LUGGAGE
At any time, all baggage and personal effects are at the client’s responsibility and the Company does not accept any liability for any loss or damage of any personal effects, howsoever arising. Clients are entitled to one bag of not more than 15 kg (backpack or soft bag – no hardtop suitcase) and a daypack. The Company reserves the right to refuse excess baggage. Please note that on our trekking tours and domestic flights, other baggage regulations may apply.
8 - CARRIERS
Carriage by air and sea is subject to the terms and conditions of the carriers with whom you are traveling and to international conventions. Betheli Expedition (T) Limited accepts no liability whatsoever for cancellations, strikes, timetable changes, diversions, technical issues unrelated to Betheli Expedition (T) Limited, lost or mislaid luggage, rescheduling costs, missed accommodation, or delays that result from any operational decision of the carrier concerned. Betheli Expedition (T) Limited accepts no liability for death, injury, or illness that derives from carriage by air or sea.
9 - RISK & RESPONSIBILITY
The client accepts that all Experiences/tours are of an adventurous nature and involve an element of personal risk. Neither the Company nor any of its agents can be held liable in any way for any injury, loss of life, or damage to property. The client hereby indemnifies the Company and will hold the Company, its agent, assigns, and servants harmless from any such claim. The client accepts full responsibility for all risks involved.
10 - AUTHORITY ON TOUR
The decisions of the Company’s guide/driver on tour shall at all times be final and binding. The client must at all times comply with the laws, customs, and foreign exchange regulations of all countries visited.
11 - MARKETING
Betheli Expedition (T) Ltd reserves the right to use any photographs and videos taken during tours for marketing purposes or any other advertising material. The client hereby gives consent to use such photographs and authorizes the Company to retain the copyright for these photographs and such material.
12 - FORCE MAJEURE
Unforeseen circumstances including but not limited to war, mechanical breakdowns, weather, riots, and other unforeseen reasons beyond the control of the Company may cause delays or alterations to the tour. The Company shall not be held liable in any way for any of these possible occurrences or any consequences, which may arise as a result of these.
13 - PRICE CHANGES
All our prices are based on the current national park fees and taxes. Should the authorities (Tanzania government) decide on increasing fees and taxes, even though they might currently not be scheduled, we would subsequently have to pass on these increases.
14 - ACCESS
We cannot be held responsible for road and airstrip conditions, which may make travel impossible at times. Any changes to the initial itinerary are subject to the conditions and rates outlined above, despite any access matters or weather conditions.
15 - INSURANCE
Betheli Expedition requires the client(s) to purchase travel insurance. The client(s) ensures to take out adequate insurance, including, death, medical, and evacuation insurance, to cover any loss or damages.
16 - CHILD POLICY
We do not accept bookings made by a child under the age of 18 unless accompanied by one of their parents.
17 - LAW (Company’s contract)
This contract and any matters arising from it shall be governed by and interpreted in accordance with Tanzania law and the courts of Tanzania shall have exclusive jurisdiction to hear any and all proceedings between us either relating to our contract or arising out of it.
